Nicolian Holidays - Terms and Conditions
For bookings of The Riverside at Helford between Nicolian Holidays Limited ("Nicolian Holidays") and Clients staying at The Riverside ("the Guest").
Your Contract With Us
Our acceptance of your deposit forms a contract between Nicolian Holidays Limited and the party leader (first named guest - hereinafter referred to as "the Guest"), acting as principal and accepting responsibility for sums due from and actions by all guests in the party booked in the name of the Guest whether now, or subsequent to or on arrival at The Riverside. These booking conditions apply and the Guest is deemed to have accepted them on the basis aforesaid. The Guest warrants that he or she has read and signed the attached Booking Form and in particular agrees to the declaration contained in it.
Deposits and Bookings
All bookings must be made on and subject to the terms contained in the enclosed Booking Form which must be signed by the Guest.
A deposit of 25% of the total holiday cost must accompany the Booking Form.
Once a booking is confirmed by Nicolian Holidays, the Guest is liable for the full cost of the holiday; the balance being due ten weeks prior to the commencement of the holiday or with the deposit if booking within ten weeks of the commencement of the holiday. Holidays booked within two weeks of the date of the commencement of the holiday must be paid for by bank transfer to our bank. It is regretted that reminders for this balance cannot be given and that non-payment by the due date could be treated as cancellation, the property being considered available for re-letting without further reference to the Guest. In the event of the property not being re-let then the Guest would be liable for the amount due as referred to below in the section titled "Cancellation by the Guest".
A Damages Deposit of £200 is payable with the balance which is held to cover all or any part of any loss and damage to the property and the boats provided. This Deposit will be refunded, less any appropriate deductions, within 21 days of the end of the holiday. If any damages/breakages exceed £200 then they will be charged to the Guest and must be paid for by the Guest. The Guest shall indemnify Nicolian Holidays in respect of all or any claims made against Nicolian Holidays Limited as a result of negligence by guests and against wilful acts of destruction and damage caused to the property, its contents or the boats provided, to the extent that Nicolian Holidays Limited is not covered by its insurance policy, but this shall not reduce or affect any claim for damage on the part of Nicolian Holidays Limited lying in contract or in tort against the Guest or any guest in the party.
Cancellation by the Guest
Having booked a holiday and paid a deposit, if a Guest subsequently cancels that holiday then a cancellation charge will be made as follows:

Cancellation by Nicolian Holidays or due factors outside the control of Nicolian Holidays Limited
In the unlikely event that Nicolian Holidays cancels a holiday then the full amount of the booking (including any deposit paid) will immediately be refunded.
In the event of cancellation due to factors beyond the control of Nicolian Holidays then, due to the unpredictable and uncertain nature of this risk, Nicolian Holidays will endeavour to agree a reasonable compromise settlement with the guest given the circumstances but the non-refundable deposit will not be repaid. We recommend that the guests insure against this risk.
Insurance
We strongly recommend that guests take out travel insurance cover against cancellation, losses and damage to the personal effects, personal accident, medical and associated expenses and personal liability.
Use of Boats
The Cygnus Motor Launch, its tender are used entirely at the Guests risk. Nicolian Holidays will not accept responsibility for loss or damage to belongings of the Guest, the guests in the party or others, or (subject to the terms of the section headed “Liability” hereafter) for personal injury or loss of life caused by the operation of these boats which is beyond the control of Nicolian Holidays. Subject thereto the use of these boats is granted strictly on the following basis. The following should be read in conjunction with the enclosed Use of Boats criteria:
Prior to setting out, guests should take notice of the local weather forecast to ensure that conditions are appropriate. They should also be aware of tide times. If in any doubt they should consult our representatives at Sailaway St Anthony (Tel: 01326 231357).
The Cygnus Motor Launch will only be driven by guests over the age of 21 who have been instructed on its use by our representatives and who have read the instructions to be found in the rear hold of the boat (a copy of which is also available at the property).
Life jackets must be worn at all times.
None of the boats should be taken outside the area indicated by our representatives.
Any damage to the boats arising out of misuse or as a result of negligence and/or failure to follow the instructions given, will be chargeable to the Guest.
The Cygnus Motor Launch is not suitable for beach landings. It should be anchored securely and the tender used for access to beaches.
Nicolian Holidays Limited are under no obligation to provide alternative boats if the Cygnus out of use due to circumstances beyond our control.
The use of the boats is not available or included in the winter rates (i.e. November - April).
Behaviour
Our guests must undertake to behave in such a manner so as not to disrupt the enjoyment of other people staying in the area, or prejudice our reputation as the owners of the property. The holiday of any guest in breach of this clause may be terminated immediately and without compensation or any further obligation.
Animals
We regret that animals are not permitted at the property.
Smoking
Smoking is not permitted inside the buildings.
Liability
Nicolian Holidays will not be liable for any act, neglect or default, nor for any accident, damage, loss, injury, expense or inconvenience, whether to person or property which any Guest or any member of his or her party may suffer arising out of or in connection with the holiday or the facilities provided on the holiday or as a result of any other cause, whatever that may be. Provided always that nothing in these Terms and Conditions shall operate or be construed so as to exclude or restrict the liability of Nicolian Holidays for death or personal injury caused to any guest by reason of the negligence of Nicolian Holidays Limited or of its directors, servants, employees or agents.
